Scumbag Montreal Muslim couple acquitted of terror charges
« on: December 21, 2017, 10:57:44 pm »
Interesting story:  http://montrealgazette.com/news/local-news/terror-trial-djermane-not-guilty-on-all-counts-jamali-convicted-on-explosives-charge

A Canadian Muslim couple, 19 & 18 at the time, acquitted on all terror charges, including attempting to join ISIS in Syria in 2015.  Only charge that stuck was possession of an explosive device without lawful excuse.  Let's review the evidence shall we!

- Couple are both Muslim and booked a trip to Greece in 2015, which is the only western European country to border the middle-east (Turkey, which neighbours Syria).
- The parents of both admitted they were unaware Djermane and Jamali had stopped attending courses at Collège de Maisonneuve weeks before they were arrested.
- Couple had researched ISIS on mainstream media sites.
- The RCMP found a step-by-step guide/recipe for a pressure cooker bomb (which was used in the Boston Marathon bombing) on the bedside table in the couple's condo.
- RCMP officers discovered a pressure cooker and a dollar-store bag full of ingredients required for that recipe, including matches, a clock, coffee filters and nails.  Jamali had used his own debit card to purchase the items and left everything, including the receipt, in one shopping bag that was found when INSET investigators searched his parents home.
- The Crown had evidence the couple purchased plane tickets to Greece and had reported their passports stolen in order to obtain new ones. In fact, their passports were never stolen  but were being kept by the parents of both (so, passport fraud by lying on a passport application - MG) after several students at Collège de Maisonneuve reportedly left Canada to join ISIL in its efforts to establish an Islamic state. During their bail hearing, Jamali’s father said he kept his son’s passport in a safe at home. Greece is considered to have been the first destination for many people who sought to join ISIL by travelling to Syria though Turkey. But the Crown had no evidence to prove the couple planned to travel beyond Greece.

So scumbags are set free with time served, are still in love, and have a peace bond and will be monitored by RCMP.  Give me a break!

and yet, with all that reported evidence, the jury acquitted them. Jeez, I wonder why that was?

Some of the evidence is more damning than other.  eg. A Muslim went to Greece... ok.

But what would you do with such people ?  Life in prison ?

Because they didn't have evidence beyond a reasonable doubt, I guess. That's how juries work. I'm surprised you didn't know that.

Muslims research how to build a bomb, buy the necessary ingredients to build the bomb, including nails, get passports so they can flee the country....

If they were both found dead with bullets behind the ears I wouldn't think there'd be an injustice done.

Deport them back to Morocco.

I suppose there could be an appeal.

Lots of idiots who ran away to join ISIS received horrifying comeuppance.  I don't feel happy about that but I also know that it is an unsurprising result.

It seems to me that such people are a definite risk and worth monitoring.  But can you charge them ?  With what ?  I guess it's a legal question from me.

Deport them back to Morocco.

You can't deport Canadians, though.  I am not wholly uncomfortable with the idea of rescinding citizenship but it doesn't seem effective or practical.  I'm open to it, though.

They had no firm evidence they were going to Syria, which is true.

Muslims read about ISIS online, stop going to school, apply for passport via fraud because parents took away passports for fear they would flee to Syria & fight for ISIS, buy tickets to Greece, research building a bomb, buy bomb materials...

What other conclusion could be drawn?

They should by minimum be under tight surveillance by RCMP/CSIS/CSEC for the rest of their lives as serious terror threats.

You can rescind citizenship for things like application fraud, ie: lying on your application. So what if you break your oath of citizenship?

I don't think taking away citizenship is very effective to fight terror, I'd prefer throwing them in prison to serve hard time instead of sending them back to commit terror somewhere else.

You would think that if any province could muster a jury to convict Muslims of terror, it would be Quebec.  One wonders what went wrong.

Yes, one wonders. Maybe nothing went wrong.  A jury sits there for weeks listening to the prosecution present evidence and witnesses and concludes that the two should be acquitted . A bunch of others read a newspaper summary of the trial and concludes that the jury got it wrong.

It happens all the time.  Lots of trials have people upset at the verdict.  Sometimes there are even riots!
