I don't think that Trump can put any silly argument forward and just count on the justices to go his way. I recall something in history where presidents tried that and it failed. Even ACA got through a Republican majority court.
True, in the 2012 decision the Affordable Care Act was considered constitutional. But, it was a 5-4 decision, with Roberts acting as a swing vote. Now, with Ginsburg gone (and replaced by a stepford wife) , I suspect that the decision would now go 5-4 against the ACA.
As for them ruling on the election.... its possible that enough of them might rule against Stubby McBonespurs. Of course, it all depends on how close the election is and the nature of the legal arguments. But, keep this in mind:
- 3 of the justices (Roberts, Drunky McRapeface, and the Stepford Wife) all spent at least part of their time working on Bush v. Gore (on the Republican side)
- One of the sitting supreme court justices (Thomas) was on the supreme court at the time, and ruled in favor of Bush
- Gorsuch wasn't involved in Bush v. Gore in any way, but during his confirmation hearings, he stated that it was a precedent worth respecting.
- Drunky McRapeface has already made comments about how bad it is if the election results are late
